How is PancakeSwap taxed in Germany?

In short

When you put tokens into a PancakeSwap pool as liquidity, TaxMaxi reads that as a swap for your position, and withdrawing as a swap back. A gain on it is taxable under § 23 of the Income Tax Act (EStG) if you held the tokens you gave up for no more than a year, unless your gains from all private sales together stay under €1,000 for the year.

Staking the position in a PancakeSwap farm is no swap: it stays yours. The position's fees and the CAKE the farm pays are income from other services under § 22 Nr. 3 EStG once you collect them, and they're tax-free as long as they stay under €256 for the year together with your other income of this kind. A swap on PancakeSwap counts like any other swap.

What is PancakeSwap?

PancakeSwap is a decentralized exchange, mainly on BNB Chain. Its code comes from Uniswap: in v2 you get an LP token for your liquidity, the Cake-LP, and in v3 you place it in a price range and get an NFT for your position. What PancakeSwap adds of its own is farming: you can stake your position in a farm, the MasterChef, and get CAKE for it, PancakeSwap's own token.

  1. The app pancakeswap.finance You pick the pool, add liquidity and stake it in the farm.
  2. The positions 0x46a1…4364 The v3 contract keeps your liquidity as an NFT and pays it back out with the fees.
  3. The farm 0x556b…d59e MasterChefV3 holds the NFT of your staked position and pays you CAKE for it. Cake-LP from v2 is staked in MasterChef v2, and until 2022 it went into the first MasterChef.

For tax, what counts is what your wallet gives up and receives: tokens into the position, tokens back out of it, fees and CAKE. How staking works technically is in PancakeSwap's docs.

What applies in general, on every chain and with every provider: Liquidity Pools taxes.

  1. PancakeSwap v3: positions0x46a1…4364keeps your liquidity on PancakeSwap v3 as an NFT

On 2 June 2026 the wallet put just over 0.008 BTCB and 0.84 BNB into a pool of BTCB and BNB and staked the NFT in MasterChefV3. On 6 June it collected fees and CAKE. On 18 June it took the NFT back, with the farm paying the remaining CAKE, and a minute later it withdrew all the liquidity. Less BTCB and more BNB came out than had gone in, because the price had moved. The fees in this transaction are income, and the withdrawal is a swap of the position back into the two tokens.

An example in euros

You buy BNB and CAKE in January, add both as liquidity on PancakeSwap in February and stake the position in the farm. In June you collect CAKE and fees, and in November you withdraw everything. This is how TaxMaxi works out the position:

  1. 10 January 2025Bought 1 BNB for €600.00
  2. 10 January 2025Bought 200 CAKE for €400.00
  3. 1 February 2025Into the position: 1 BNB, worth €650.00
  4. 1 February 2025Into the position: 200 CAKE, worth €450.00
  5. 1 February 2025Position received, cost €1,100.00
  6. 15 June 2025Position fees: 0.01 BNB, worth €6.00
  7. 15 June 2025Farm reward: 20 CAKE, worth €36.00
  8. 20 November 2025Position swapped back for €1,050.00
  9. 20 November 2025Out of the position: 0.95 BNB, worth €570.00
  10. 20 November 2025Out of the position: 230 CAKE, worth €480.00

The income of 2025 stays under the exemption limit of €256: if, together with interest, staking rewards and other income under § 22 Nr. 3 EStG, it's your only income of this kind in the year, you pay no tax on it. The swaps of 2025 add up to +€50.00, the loss on swapping back set against the gains on depositing. That is under the exemption limit of €1,000 for private sales: if it's your only gain in the year, you pay no tax on it.

Worked out by TaxMaxi's tax engine, on the same principles as for your wallet.

The legal basis

Whether a swap costs tax is set by the Income Tax Act (EStG), above all § 23 EStG on private sales. How tax offices apply this to crypto is set out in the finance ministry's letter of 6 March 2025, which binds them.

The letter is divided into numbered paragraphs (Randnummern). Each principle below says where to find it; a click opens the letter at that spot.

  1. 1

    Liquidity in a pool

When you put tokens into a liquidity pool, we treat that as a swap for your position: they count as disposed of at their market value, and that value is the position's cost basis. When you withdraw liquidity, we treat that as a swap back: the position's share, what was paid in first going first, counts as disposed of at the market value of the tokens that come back, and you acquire those tokens anew, with a new holding period. That's also where impermanent loss shows up. The finance ministry's letter says nothing about liquidity pools. Even whether paying in is a disposal at all is disputed, and with it the new holding period: the other reading sees the position as a mere receipt and the deposit as a loan. We take the cautious reading.

    See the BMF letter, paragraphs 53, 54, 58, 59 and 61

  2. 2

    Fees from a pool

Fees and rewards that a position in a liquidity pool pays you are income under § 22 Nr. 3 EStG when you collect them, at their market value on that day, and each one gets its own acquisition date. What the position had earned by the end of the year but not yet paid out can't be looked up for past years, so it counts when you collect it.

See the BMF letter, paragraphs 43, 45, 48 and 65

  3. 3

The exemption limit (Freigrenze) for income

Income from other services under § 22 Nr. 3 EStG is tax-free if it stays under €256 in the year.

See the BMF letter, paragraph 45

  4. 4

    A swap is a disposal

A swap disposes of the token you give up and acquires the one you receive. A gain is taxable if there's no more than one year between the acquisition and the swap.

See the BMF letter, paragraphs 53 and 54

  5. 5

    One-year holding period

The year runs from the day of acquisition to the swap, and each swap starts it again for the token you receive. There's no extension to ten years. For tokens you acquire from 2027, a finance ministry draft would drop the holding period: What is set to change from 2027.

See the BMF letter, paragraphs 55 and 63

  6. 6

    Fees

A swap's network fee counts as deductible expenses (Werbungskosten) and reduces the gain, but only on a taxable swap.

See the BMF letter, paragraphs 57 and 59

  7. 7

    The exemption limit (Freigrenze)

If the sum of all your gains from private sales in the year stays under €1,000 (up to 2023: €600), it's tax-free. Above that, all of it is taxable, not only the part over the limit.

See the BMF letter, paragraph 53

Common questions

Is liquidity on PancakeSwap a swap?

TaxMaxi reads it as one: when you put tokens into a pool, they count as disposed of at their market value, and that value is your position's cost basis. When you withdraw the liquidity, you swap the position back, and the tokens that come out start a new one-year holding period. The finance ministry's letter of 6 March 2025 doesn't name liquidity pools explicitly; TaxMaxi follows what it says about swaps (paragraph 54).

Is staking in the farm a swap?

No. Your position stays yours, even while the NFT or the Cake-LP sits in MasterChef: it keeps its acquisition date and its cost basis, and when it comes back, that's no new acquisition. If you withdraw liquidity through the farm or add more, TaxMaxi reads that the same way as through the positions contract.

How is CAKE from the farm taxed?

As income from other services under § 22 Nr. 3 EStG, on the day you collect it, at its value that day. The same goes for the fees your position earns. If your income of this kind stays under €256 for the year in total, it's tax-free. Collecting starts a separate one-year holding period for the CAKE, and if you later sell or swap it, that's a swap like any other.

What about impermanent loss?

It shows up when you withdraw: if what comes out is worth less than the position cost, that's a loss on the swap back. If you held the position for no more than a year, it counts for tax and is offset against gains from private sales.

Does gas count as deductible expenses (Werbungskosten)?

On a taxable swap, yes: it reduces the gain (BMF letter, paragraph 59). On BNB Chain you pay gas in BNB, and that's a small swap too.

What doesn't TaxMaxi read on PancakeSwap yet?

PancakeSwap on chains other than BNB Chain, PancakeSwap Infinity, and a position the farm hands to another address. TaxMaxi puts such transactions in front of you in the review, and you say what happened.
