How is ETH staking with your own validator taxed in Germany?
In short
Staking ETH in your own validator isn't a disposal: the ETH sit on the Beacon Chain, locked but still yours. Every reward the Beacon Chain pays you, roughly once a week, is income under § 22 Nr. 3 of the Income Tax Act (EStG), at its euro value on the day it's paid out. If your income of this kind stays under €256 for the year, you pay no tax on it.
The payout is also when you acquire the new ETH. Sell or swap them within a year and the gain on them is taxable under § 23 EStG; after that it's tax-free. For the ETH you staked, the one-year holding period just keeps running. When you exit the validator they come back, with no new acquisition.

What is native staking on Ethereum?
Native staking means running a validator, one of the computers that propose and confirm blocks on Ethereum. To do that, you send 32 ETH with a deposit to Ethereum's deposit contract. The ETH stay yours: they can only come back to the withdrawal address you set in the deposit, usually the wallet you stake from.
The validator earns rewards for its work. Whatever its balance grows beyond 32 ETH, the Beacon Chain pays out to the withdrawal address roughly once a week. You don't have to do anything, and no transaction appears in your wallet. When you exit, it pays out the whole balance: the 32 ETH plus whatever has built up since the last payout.
- The wallet the Launchpad or a staking app You generate the validator's keys and send the 32 ETH with its deposit.
- The contract 0x0000…05fa Ethereum's deposit contract takes the ETH and registers the validator with the Beacon Chain.
- The Beacon Chain Ethereum's consensus It keeps your validator's balance and pays rewards, and in the end the stake, to your withdrawal address.
For tax, all that counts is what happens to your ETH: staked isn't disposed of, every payout beyond your stake is income, and only a sale or swap is a disposal. That holds on every chain: How staking is taxed in Germany.

Staking ETH on the blockchain
A real deposit into a validator of its own from a public wallet, the way TaxMaxi reads it. Next to each item the wallet gives up, you see what it means for tax.

The rewards don't appear in any transaction: the Beacon Chain pays them out at the end of a block. So TaxMaxi reads them separately, and that's how just over 0.015 ETH reached this wallet every week from August 2023, each one a reward on its day, at that day's ETH price. In March 2024 the validator exited and paid out just over 32.0067 ETH: the 32 staked ETH came back with their purchase date, and only the rest was a reward.
An example in euros
You buy 32 ETH in March 2023, stake them in your own validator in June, exit in March 2024 and sell everything in April. Instead of every payout the example shows four, and the euro values are assumed. Here's how TaxMaxi works out the rewards and the sale:

Each year's rewards stay under the exemption limit of €256 for income like this. If, together with interest from lending and other income under § 22 Nr. 3 EStG, they're your only income of this kind in the year, you pay no tax on them. From €256 the whole amount is taxable, at your personal tax rate. The taxable gain of €118.14 in 2024 is under the exemption limit of €1,000 for private sales: if it's your only one in the year, you pay no tax on it. The gain of €59,200.00 on the ETH held for more than a year is tax-free.
The 32 ETH were staked in the validator most of the time and kept their purchase date of 1 March 2023: at the sale they had been held for more than a year, so the gain on them is tax-free. Staking doesn't extend the period.
Worked out by TaxMaxi's tax engine, on the same principles as for your wallet.
The legal basis
Whether staking costs tax is set in two places in the Income Tax Act (EStG): rewards are income from other services under § 22 Nr. 3 EStG, and a later sale or swap of the ETH is a private sale under § 23 EStG. How tax offices apply this to crypto is set out in the finance ministry's letter of 6 March 2025, which binds them.
The letter is divided into numbered paragraphs (Randnummern). Each principle below says where to find it; a click opens the letter at that spot.

1
Staked coins
Coins you stake from your wallet, SOL into a stake account or ETH into a validator of your own, are tied up, not transferred. Nothing is disposed of, and when the stake comes back, that's not an acquisition.
See the BMF letter, paragraph 13

2
Rewards from your own validator
If you run your own validator, you take part in creating blocks. Its rewards are income under § 22 Nr. 3 EStG at their market value when they arrive in your wallet: on Ethereum with each Beacon Chain withdrawal, about every week. If you run validators on a sustained basis and at a larger scale, it may be a commercial activity.

The exemption limit (Freigrenze) for income
Income from other services under § 22 Nr. 3 EStG is tax-free if it stays under €256 in the year.
See the BMF letter, paragraph 45

One-year holding period
The year runs from the day of acquisition to the swap, and each swap starts it again for the token you receive. There's no extension to ten years. For tokens you acquire from 2027, a finance ministry draft would drop the holding period: What is set to change from 2027.

The exemption limit (Freigrenze)
If the sum of all your gains from private sales in the year stays under €1,000 (up to 2023: €600), it's tax-free. Above that, all of it is taxable, not only the part over the limit.
See the BMF letter, paragraph 53
Common questions
Is ETH staking with your own validator taxable?
The staking itself isn't: your ETH are locked but not transferred (the finance ministry's letter of 6 March 2025, paragraph 13), so nothing is disposed of. The rewards are taxable: with your own validator you take part in block creation, and rewards from that are income under § 22 Nr. 3 EStG, at their market price when acquired (paragraphs 33, 45 and 47). You only pay tax on them once your income of this kind reaches €256 for the year.
When does a reward from my validator count?
On TaxMaxi's reading, when it arrives in your wallet: with the Beacon Chain's payout, roughly once a week. Until then only the validator's balance grows, and you can't get at that. Nothing says this explicitly for Ethereum. There were no payouts until April 2023; the rewards from the years before came all at once with the first payout, and TaxMaxi counts them on that day.
Is exiting the validator taxable?
No, as far as it gives you back your staked ETH: they return with their purchase date and their cost, with no new acquisition. Whatever the exit pays beyond your stake is the last reward and counts as income. If you sell the ETH afterwards, the holding period runs from the purchase, not from the exit.
Is running your own validator a commercial business?
It can be. The BMF letter doesn't see block creation as private asset management (private Vermögensverwaltung, paragraph 39). Whether it's commercial depends on whether it's sustained, aimed at profit and takes part in general commerce (paragraphs 35 to 38). If it is, the rewards count as profit from a commercial business (Gewerbebetrieb), not under § 22 Nr. 3 EStG. TaxMaxi treats them as other income; if you run many validators, have the classification checked.
How high is the exemption limit for staking?
€256 a year, for all income from other services under § 22 Nr. 3 EStG together: staking rewards, interest from lending and the like (paragraph 45). It's an exemption limit (Freigrenze), not an allowance (Freibetrag): stay under it and all of it is tax-free; reach €256 and the whole amount is taxable. The €1,000 for gains from private sales is a separate limit, and that one applies to selling the ETH.
How is this different from Lido and staking providers?
With Lido you hand over ETH and get stETH: that's a swap, the ETH count as disposed of, and the growth of the stETH only counts when you swap back. With a staking provider or an exchange, the rewards are income from passive staking when they're credited to you (paragraph 48). With your own validator you keep your ETH, and every payout beyond the stake is income.
How do I get a tax report for my validator?
Add your validator's withdrawal address to TaxMaxi. When it syncs, TaxMaxi reads the Beacon Chain's payouts to that address along with the transactions, values each reward at the day's price and takes off your stake at the exit. For each tax year you get a PDF report with your staking income and every sale with its gain. The first transactions are free.
What doesn't TaxMaxi read yet for native staking?
The fees your validator gets for proposed blocks, when they're credited without a transaction, and deposits through a staking provider's batch contract. An exit whose stake came from another wallet, or a deposit through another contract, comes to you in the review, and you say what happened.
